Agreement to these terms

By downloading, accessing, or using Sojourn (the "app"), you agree to these Terms of Service (the "Agreement"). If you do not agree, please do not use the app.

Sojourn is provided by Gallantin ("we", "us", or "our"). These terms govern your use of the app and all related services.

What Sojourn is

Sojourn is an atmospheric audio app. It offers painted realms and doors you can step into, each with its own ambient soundscape, made for rest, focus, and sleep.

Sojourn is for relaxation and enjoyment. It is not a medical, therapeutic, or healthcare service, and it makes no health claims.

Using the app, with or without an account

You can use the app as a guest, with no account. An account is optional and only exists so your record and playlists can follow you across devices.

If you create an account:

• Age requirement: you must be 13 or older to use the app. If you are in the European Union or the United Kingdom, you must be at least 16, or the minimum digital-consent age in your country, whichever is higher.
• Account responsibility: you are responsible for the security of your sign-in and for activity under your account.
• One account per person: each account is for your personal use.
• Honest use: do not create accounts using false information or for fraudulent or harmful purposes.

Subscriptions and payments

Some rooms open only with the Key, our membership. The Key is a single purchase or subscription managed through your app store.

• Plans and pricing: the Key is offered at 4.99 US dollars per month with a 7-day free trial, 29.99 US dollars per year, or 69.99 US dollars once for lifetime access. Prices are shown in your local currency by the App Store or Google Play and may vary by region.
• Billing: subscriptions are managed by the Apple App Store (iOS) or Google Play (Android). Your chosen store charges your payment method and handles renewals.
• Auto-renewal: monthly and yearly plans renew automatically unless you cancel. If you start with the 7-day free trial, it converts to a paid monthly subscription unless you cancel before the trial ends. Lifetime access is a one-time purchase and does not renew.
• Cancellation: cancel any time through your App Store or Google Play account settings. Cancel before the next billing date to avoid the next charge. We cannot cancel or refund a store subscription for you.
• Refunds: except where required by law, payments are non-refundable. Refund requests are handled by the App Store or Google Play under their policies.
• Price changes: if we change subscription pricing, your store will ask for your consent before an increase takes effect, as required by the store rules.

For rest and relaxation

Sojourn provides ambient audio and visuals for relaxation, focus, and sleep. It is not a medical device, a therapy, or a substitute for professional care, and no clinical claims are made. If you have health concerns, please speak with a qualified professional.

Content and intellectual property

• App content: the artwork, audio, and text in Sojourn are owned by Gallantin or its licensors and are provided for your personal, non-commercial enjoyment. You may not republish, redistribute, or resell them.
• Your content: the playlists you build and the record of where you wander are yours. Using the app does not transfer ownership of them to us.
• Our rights: the app, including its design, code, and interface, is the intellectual property of Gallantin. You may not reverse-engineer, decompile, or attempt to extract its source code.

Acceptable use

You agree not to:

• Use the app for any illegal or harmful purpose.
• Attempt to gain unauthorized access to the app or its servers.
• Disrupt the app through technical attacks, automated abuse, or other malicious means.
• Copy, resell, or commercially exploit the app or its content without our permission.

Termination

You may stop using the app and delete your account at any time in Settings. When you do, your data is removed from our servers as described in the Privacy Policy.

We may suspend or end your access if you break these terms, use the app unlawfully, or act in a way that harms the app or other people.

Limitation of liability

The app is provided "as is" and "as available". To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
• We are not responsible for service interruptions, data loss, or technical failures beyond our reasonable control.
• Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months before the claim.

Changes to these terms

We may update these terms from time to time. Changes take effect when we post them, with an updated date at the top of this page. Your continued use of the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts of England and Wales for any dispute.

Indemnification

You agree to indemnify and hold Gallantin harmless from claims, damages, losses, and expenses, including reasonable legal fees, that arise from your violation of these terms, your unlawful use of the app, or your infringement of any third-party right.

Entire agreement

These terms, together with the Privacy Policy, are the entire agreement between you and Gallantin about the app, and they supersede any prior agreements or communications.

Severability

If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of the terms remain in full force.

Waiver

If we do not enforce a provision of these terms, that is not a waiver of our right to enforce it later. A waiver is only effective if it is in writing.

Acknowledgment

By using Sojourn, you acknowledge that you have read these terms, understood them, and agree to be bound by them.
